Terms of Service
These Terms of Service ("Terms") govern your use of the issa mobile application ("the App") operated by Sideye Inc. ("the Company," "We," "Us," or "Our"). By downloading or using the App, you agree to these Terms. If you do not agree, do not use the App.
1. Use of the App
The App provides real-time voice, camera, and text translation services. You may use the App for lawful personal and commercial purposes. You agree not to:
- Use the App for any unlawful, harmful, or fraudulent purpose
- Attempt to reverse engineer, decompile, or disassemble the App
- Interfere with or disrupt the App's functionality or servers
- Use the App to transmit malicious code or harmful content
- Resell, redistribute, or sublicense the App without Our written consent
2. Account & Access
The App does not require account creation. No sign-in or personal information is needed to use the core features. Premium features are unlocked through in-app subscriptions managed by Apple.
3. Subscriptions & Payments
The App offers optional premium subscriptions. All payments are processed by Apple through the App Store. By subscribing, you agree to Apple's terms of purchase. Key details:
- Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period
- You can manage or cancel subscriptions in your Apple ID settings
- Refunds are handled by Apple per their refund policy
- We do not collect or store any payment information
4. Translation Accuracy
Translations are generated by AI and may not always be perfectly accurate. The App is a communication aid, not a certified translation service. You should not rely on the App for translations where errors could cause harm, including but not limited to legal, medical, or safety-critical contexts. We are not liable for any consequences arising from translation inaccuracies.
5. Third-Party Services
The App uses third-party services to deliver its functionality:
- OpenAI — processes voice, camera text, and typed text for translation
- Apple — provides on-device processing, payment handling, and App Store distribution
- Superwall — manages paywall and subscription triggers
Your use of the App is also subject to these providers' terms and policies. We are not responsible for third-party service outages or changes.
6. Intellectual Property
All content, design, code, and trademarks in the App are owned by Sideye Inc. and are protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for its intended purpose. This license does not transfer any ownership rights to you.
7. Privacy
Your privacy matters to Us. Our collection and use of data is described in Our Privacy Policy, which is incorporated into these Terms by reference.
8. Disclaimer of Warranties
The App is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the App will be uninterrupted, error-free, or free of harmful components.
9. Limitation of Liability
To the maximum extent permitted by applicable law, Sideye Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or related to your use of the App, regardless of the theory of liability. Our total liability shall not exceed the amount you paid for the App in the twelve (12) months preceding the claim.
10. Indemnification
You agree to indemnify and hold harmless Sideye Inc., its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the App or violation of these Terms.
11. Termination
We may suspend or terminate your access to the App at any time, without notice, if We believe you have violated these Terms. Upon termination, your right to use the App ceases immediately. Sections that by their nature should survive termination will remain in effect.
12. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of Delaware.
13. Changes to These Terms
We reserve the right to update these Terms at any time. Changes are effective upon publication within the App. Continued use of the App after changes constitutes acceptance of the updated Terms.
